Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the products, applications, and websites provided by Nimets (“we”, “us”), operated by Rath Socheat in the Kingdom of Cambodia. By downloading, installing, or using our products, or by making a purchase, you agree to these Terms. If you do not agree, do not use the products.

1. General terms (all products)

Our products are licensed, not sold. We grant you a personal, non-exclusive, non-transferable, revocable license to use them in accordance with these Terms. You agree not to reverse engineer, decompile, or attempt to circumvent any licensing or activation mechanism (except where such restriction is prohibited by law), resell or redistribute a product or license, or use a product for any unlawful purpose. We may add, change, or discontinue features over time, and some features described on our sites may still be in development.

2. PadLink (macOS & Windows)

PadLink presents game controllers to your games as a standard gamepad or as keyboard and mouse input. On macOS, it reads controllers your Mac may not natively recognize and can also accept input from a paired phone; it requires macOS 13 or later and is distributed directly by us (Developer ID signed), not through the Mac App Store. On Windows (Windows 10 or 11, 64-bit), a paired phone running PadLink Remote is the input source — Windows already recognizes most controllers natively — and the app is likewise distributed directly by us.

The virtual-gamepad output on Windows depends on ViGEmBus, a free third-party driver that we do not develop and that is provided under its own license and terms. The App can help you install it, but we do not warrant it. The keyboard and mouse output does not require it.

PadLink is free to use with one active controller. Optional Pro features (running up to four controllers at once) are unlocked with a one-time purchase that grants a license tied to the activation limit associated with your license key; the same key may be used with the macOS and Windows apps, subject to that limit. A time-limited Pro trial may be offered from within the App. You may not resell, sublicense, rent, or share your license key.

3. PadLink Remote (iOS & Android)

PadLink Remote is a free companion app that turns your phone into a controller for a computer running PadLink on the same local network. It is not a standalone product: without a paired computer it has no function. Downloads are handled by the Apple App Store and Google Play under their respective terms, and you must also comply with those stores' terms of use.

The Free tier of PadLink Remote is supported by advertising. Removal of ads and certain features — including the driving cockpit and its steering mode — require Pro, which is determined by the license status of the computer you pair with. There is no separate purchase inside the Remote app.

4. Khmer Chess — អុក 3D (mobile app)

Khmer Chess (Ouk 3D), package com.nimets.chess, is a free mobile app for iOS and Android. It may show advertising (via Google AdMob) and may offer optional in-app purchases. Downloads, in-app purchases, and any subscriptions are handled by the Apple App Store and Google Play under their respective terms, and you must also comply with those stores' terms of use.

5. Purchases & payment

Paid purchases of PadLink Pro are processed by Polar, our authorized payment provider, which acts as the Merchant of Record for the transaction. The provider handles payment, applicable taxes (such as VAT/sales tax), invoicing, and refund processing on our behalf. By completing a purchase you also agree to that provider’s buyer terms. After a successful purchase, a license key is sent to the email address you provide; you activate Pro by entering that key in the App. Purchases made inside Khmer Chess are billed by the relevant app store, not by us.

6. Refunds

Refunds are handled in accordance with our Refund Policy. Please review it for details on eligibility and how to request a refund.

7. Intellectual property

Our products, their names, logos, and all related content are owned by Nimets and protected by applicable laws. These Terms grant you a license to use the products; they do not transfer any ownership rights to you.

8. Disclaimer of warranties

Our products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not guarantee that a product will be uninterrupted, error-free, or compatible with every device or game. Third-party software required by some features — such as the ViGEmBus driver — is provided by its own authors under its own terms, and we make no warranty in respect of it.

9. Limitation of liability

To the maximum extent permitted by law, Nimets shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use our products. Our total liability for any claim relating to a product shall not exceed the amount you paid for it.

10. Termination

These Terms apply for as long as you use our products. We may suspend or terminate your license if you materially breach these Terms. Upon termination you must stop using the product.

11. Governing law

These Terms are governed by the laws of the Kingdom of Cambodia, without regard to its conflict-of-laws rules. If you use our products from outside Cambodia, you are responsible for complying with your local laws, and nothing here removes any mandatory consumer rights you may have in your country of residence.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Your continued use after changes take effect constitutes acceptance of the revised Terms.

Your purchase is also subject to the buyer terms of our payment provider (the Merchant of Record) and, for mobile purchases, the relevant app store. Where a translation is provided, the English version prevails in case of any discrepancy.
